SIDNEY, Neb. -- A judge said a 5-foot-1 man convicted of sexually assaulting a child was too small to survive in prison, and gave him 10 years of probation instead.

His crimes deserved a long sentence, District Judge Kristine Cecava said, but she worried that Richard W. Thompson, 50, would be especially imperiled by prison dangers.

You are a sex offender, and you did it to a child," she said.

But, she said, "That doesn't make you a hunter. You do not fit in that category."

Thompson will be electronically monitored the first four months of his probation, and he was told to never be alone with someone under age 18 or date or live with a woman whose children were under 18. Cecava also ordered Thompson to get rid of his pornography.

He faces 30 days of jail each year of his probation unless he follows its conditions closely.

"I want control of you until I know you have integrated change into your life," the judge told Thompson. "I truly hope that my bet on you being OK out in society is not misplaced."

It's no secret that perverts, at least here in America, get eaten alive in prison. They're considered the lowest of the low among the prisoners, and they get treated the worst. I think she should have just sent him to prison anyways. He probably would get raped, but since he raped a child, it sounds like just punishment to me. Too fucking bad that he's short, he shouldn't have fucked children.

I'm not sure the judge meant physcially small as in height. I think he meant small as in willpower small. In the end, I'll bet the statement was probably more humiliating than a prison sentence would be.

However, this would go to show that in reality, the US prison system is based on punishment, not improvement of the individual.

My point isn't that he's going to get the same shit he would have gotten if they had just punished him. My point was a child molester was allowed to go back into society without any real punishment. It's an absolute travesty.

Exactly; this is an issue of pure justice. It sounds very harsh, but punishment should always be allocated in the interests of the people, not of the convicted criminal.



What kind of message does this give to criminal midgets in the United State? If incarcertation is good enough for the frail and disabled, then its good enough for the short. That includes you, RAK.

I happen to be 5'6". While it may be diminutive for a 17-year-old, it's not exactly short in the same way that 5'1" is short for a fully-grown man.

But, fundamentally, I agree. It's just that I wouldn't be doing anything to warrant incarceration in the first place.

Don't take it TOO unseasoned. It's just that you're the only person on here that I know for a fact is short. Anyway, 5"6 is fairly tall, even if it was the height I was when I was 10.
